Which Countries are eligible for an E-2 Visa?

The first step for any potential E-2 investor considering the E-2 investment visa is determining whether you are eligible to apply for it. To apply for an E-2 visa, you must be a national of a Treaty Country with a valid passport of this country. The list of countries which are eligible can be found at the end of this article.
So how does it work in practice?

1. Are you a national of a Treaty Country? 

For instance, you are a German citizen with a valid German passport. Germany is a Treaty Country as per the regulations: https://travel.state.gov/content/travel/en/us-visas/visa-information-resources/fees/treaty.html. Therefore, you qualify to apply for the E-2 investment visa. It doesn’t matter that you might currently live in another country, such as Australia; you’re still eligible to apply.


2. Are you a national of two countries? 

Let’s assume you are a Brazilian national with a Brazilian passport. Brazil is unfortunately not on the list of the E-2 Treaty Countries, so you don’t appear to be eligible for the E-2 visa. But you happen to be a Brazilian citizen with dual nationality – let’s assume Italy. You would still qualify for the E-2 Visa because Italy is a Treaty Country as per the regulations.


3. Does your wife/spouse/partner have a nationality that qualifies for the E-2 visa?

Let’s assume you’re a dual citizen of China and India. Both countries do not qualify for the E-2 visa. But your wife is from Bangladesh and has a valid Bangladeshi passport. She can still apply for the E-2 visa.

The E2 Investor Visa is intended at least in part to provide a way for individuals from Treaty Countries to facilitate economic growth in the US. That is an important phrase and something to always keep in mind when looking at the requirements. The bulk of the requirements is intended to prove that the E2 Investor Visa applicant will run a business to do just that. While the list of requirements for an E2 Visa is very specific and all must be met, showing the US Government that an applicant has met all requirements is subject to a great amount of judgment. The US Immigration Officials seek to be fair, flexible, and uniform when adjudicating an E2 Investor Visa application. Make no mistake. The burden of proof is with the applicant, and the judgment of the US Immigration Official reviewing the application rises above all else. If the Immigration Official is in any way uncertain as to the applicant’s qualifications, then they can request whatever document they want until the uncertainty is resolved. The key to a successful E2 Investor Visa application is to understand or employ someone who does all of the requirements and how to prove the applicant meets them.
